2. Public Beta Status

Important Notice: Figaza is currently operating in a public beta phase. This means that:

• The platform may contain bugs, errors, or unexpected behavior
• Features may change, be modified, or removed without prior notice
• Service availability and performance may be inconsistent
• Data may be lost or corrupted during the beta period
• We are actively working to improve and stabilize the platform

By using Figaza during this public beta period, you acknowledge that you are using the service at your own risk and understand that the platform may not be fully stable or production-ready.

3. Data Responsibility Disclaimer

Critical Disclaimer: We are not responsible for the data that is loaded on our platform. This includes, but is not limited to:

• The accuracy, completeness, or validity of any data you upload or import
• The content, quality, or legality of documents, objectives, initiatives, or other information you create or store
• Data loss, corruption, or unauthorized access that may occur
• Compliance with data protection regulations or industry-specific requirements

You are solely responsible for:

5. Service Availability

We strive to provide continuous access to our platform, but we do not guarantee that the service will be available at all times. The platform may be unavailable due to:

• Unscheduled downtime due to technical issues
• Force majeure events beyond our control
• Changes or modifications to the platform during the beta period

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

6. Intellectual Property

The platform and its original content, features, and functionality are owned by Figaza and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you upload or create on the platform. By using the service, you grant us a license to use, store, and process your content solely for the purpose of providing and improving our services.

7. Limitation of Liability

To the maximum extent permitted by law, Figaza and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the platform
• Any errors or omissions in the platform's content or functionality
• Unauthorized access to or use of our servers or your data
• Interruption or cessation of transmission to or from the platform
• Bugs, viruses, or other harmful components
• Any loss or damage to data during the public beta period

Our total liability for any claims arising from or related to the use of the platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Figaza and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the platform, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion features in the platform settings.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Figaza operates, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the platform.
